citizenship in ireland
Citizenship in Ireland can be acquired through several pathways, including birth, descent, naturalization, and marriage. The laws governing citizenship in Ireland are primarily outlined in the Irish Nationality and Citizenship Acts, with the most recent comprehensive updates found in the Irish Nationality and Citizenship Act 1956 (amended by subsequent acts), and the Irish Nationality and Citizenship Act 2004.
Granted to those born on the island of Ireland to parents who are either Irish citizens or legally resident in the country.
Irish Nationality and Citizenship Act 1956 (as amended): Grants automatic citizenship to individuals born on the island of Ireland if their parents are Irish citizens, or if the parents are legally resident in Ireland (with certain conditions for non-citizen parents). This includes the 24-month rule where if a parent is not a citizen, they must have been legally resident in Ireland for at least three out of the four years immediately preceding the birth.
Allows individuals to claim Irish nationality if they have Irish parents or grandparents, subject to specific conditions.
Irish Nationality and Citizenship Act 1956 (as amended): Allows individuals to claim Irish citizenship if they have an Irish parent or grandparent. For children born abroad, they can claim citizenship if one parent was an Irish citizen at the time of their birth. For grandchildren, citizenship is conferred if one of the grandparents was born in Ireland or had Irish citizenship, and the applicant must register with the Foreign Births Register.
Naturalization is available to foreign nationals who meet residency requirements, typically residing in Ireland for at least five years out of the previous nine years, including one year immediately before the application.
Irish Nationality and Citizenship Act 1956 (as amended) and the Irish Nationality and Citizenship Act 2004: Provides the framework for foreigners to become Irish citizens through naturalization. Key requirements include:
- Residency: Applicants must have been resident in Ireland for at least five years out of the last nine years, with the last year being continuous residence immediately before the application.
- Good Character: Applicants must demonstrate good character and not have any serious criminal convictions.
- Intention to Reside: Applicants must intend to reside in Ireland or be ordinarily resident in the country.
- Application Process: Includes submitting a detailed application to the Irish Naturalisation and Immigration Service (INIS), including supporting documents and undergoing an interview if required.
Citizenship through marriage is possible for spouses of Irish citizens, who may apply for naturalization after three years of marriage and living together in Ireland.
Irish Nationality and Citizenship Act 1956 (as amended) and the Irish Nationality and Citizenship Act 2004: Allows spouses of Irish citizens to apply for naturalization under specific conditions:
- Marriage Duration: The couple must have been married for at least three years.
- Residency Requirement: The applicant must have been residing in Ireland for at least three of the five years immediately before the application.
- Good Character and Intention to Reside: The applicant must demonstrate good character and an intention to continue residing in Ireland.
